Abstract

The Constitutional Court, through guardianships, has detected several problematic situations in the prisons of the country. Through Sentence T-388 of 2013, the Court decided to take action to try to mediate the crisis. Although the Coiba-Picaleña detention center does not have the serious symptoms of others of its kind, it was considered that civil society should be alert to an eventual crisis.
One of the situations that worried us was that of children, between zero and three years old, who remain in prison with their mothers. Because with respect to children and adolescents, the Political Constitution of Colombia (Art. 44) enshrines fundamental rights. Among others, because it is of interest for the present work, to have a family and not be separated from it, care, love, education and culture, recreation and free expression of opinion.
With sound judgment, the present project intends to conceive a research that allows us to identify the situation of infants held in Picaleña. The effectiveness of protection policies at the national, departmental and regional levels during the time they remain with their mothers in prison and the effects they generate in the mother-child relationship and with the family outside the penitentiary. The project also becomes an opportunity to examine the criminal and criminal procedural norms that deal with pregnant women, during and after childbirth, in order that family growth, at least in the first years, be a reality and not mere rhetoric. It will be the opportunity to demand special treatment for pregnant women, nursing and in the process of raising their children as a means to discount the prison sentence.
